rel=\"noreferrer noopener\">Karen Crawford<\/a><\/p>\n<p>I remember as though it were yesterday when the\u00a0<a href=\"http:\/\/www.epa.gov\/oust\/fedlaws\/cfr.htm\">Underground Storage Tank (UST) regulations<\/a>\u00a0were finalized in 1988, requiring owners and operators to register existing as well as new tanks, then ensure prevention, detection and remediation of releases into the environment. \u00a0 Owners and operators were also required to perform release detection inspections and demonstrate financial responsibility for cleaning up releases.\u00a0 \u00a0New tanks were required to meet certain design, construction and installation requirements aimed at preventing releases.\u00a0 While technology for meeting those requirements has evolved over the ensuing 27 years, no significant regulatory changes have been implemented \u2013 that is, until this week.\u00a0<\/p>\n<p>Many owners and operators decided to pull or close USTs in lieu of meeting those regulatory requirements but, because certain tanks are underground for safety reasons, that was not always a viable alternative.\u00a0 Because I was new to private practice and saw an opportunity, I set out to become the \u201cQueen of USTs\u201d in the Carolinas.\u00a0 These days, I still help clients on remediation projects involving releases from USTs and review due diligence reports on real estate where USTs are or have been used, but it has been a long time since I gave a speech or wrote an article about UST regulation.\u00a0<\/p>\n<p>On July 15, 2015, EPA promulgated a\u00a0<a href=\"http:\/\/www.federalregister.com\/Browse\/Document\/usa\/na\/fr\/2015\/7\/15\/2015-15914\">final rule<\/a>\u00a0modifying the 1988 UST regulations implementing requirements for secondary containment and operator training applicable to both new and existing USTs, implementing key provisions of the\u00a0<a href=\"http:\/\/www.gpo.gov\/fdsys\/granule\/USCODE-2010-title42\/USCODE-2010-title42-chap82-subchapIX-sec6991\">Energy Policy Act of 2005<\/a>\u00a0(which modified Subtitle I of the Solid Waste Disposal Act) and fulfill objectives in EPA\u2019s August 2006\u00a0<a href=\"http:\/\/www.epa.gov\/oust\/fedlaws\/tribalst.htm\">UST Tribal Strategy<\/a>\u00a0ensuring parity in program implementation among states, territories and in Indian country.\u00a0 Citing two peer-reviewed but unpublished studies of causes for releases from USTs, along with statistics showing there are still as many as 6000 releases from USTs discovered each year, and touting development of new, the 2015 changes to the original regulations are aimed at ensuring the USTs are still working as intended, by focusing on operation, maintenance and training requirements.\u00a0<\/p>\n<p>While certain waste water treatment facility and nuclear power facility partial or complete deferrals are continued, this regulation removes deferrals set forth in 1988 for field-constructed tanks, airport hydrant fuel distribution systems that meet the UST definition, and UST systems storing fuel solely for use by emergency power generators.\u00a0 Hospitals, airports, communications providers and utilities should particularly take note of these changes.<\/p>\n<p>This blog would grow to an article if it addressed in detail all of the technical requirements of this 117-page regulation, but there are some that take effect immediately and require attention.\u00a0 For example, regulations disallowing flow restrictors in vent lines to meet the overfill prevention requirement at new installations, and also triggered when an existing flow restrictor is replaced, apply immediately on the effective date of this final regulation, July 15, 2015.\u00a0 Also, testing following a repair is required on the effective date of the regulation.\u00a0 Most of the other implementation deadlines for notification, testing, inspection, recordkeeping, demonstrations of financial responsibility compatibility and required technology upgrades are set at three years after the effective date of the final 2015 UST regulation or July 15, 2018.\u00a0<\/p>\n<p>There is one exception to the deadline for compliance being either immediately or in 3 years.\u00a0 The secondary containment requirement is implemented for all new UST systems 180 days after the effective date of the rule, and tanks and piping installed or replaced after April 11, 2016 must be secondarily contained and use interstitial monitoring per the regulation.\u00a0 EPA explains that 180 days allows owners and operators to adapt plans for new systems.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Training of owners and operators (definitions for three classes are set out in this regulation) must be completed within the three years after the effective date of this regulation.\u00a0\u00a0 EPA explained that requirements for implementing walkthrough inspections and release detection equipment testing were adjusted to correspond to the training deadline so inspectors and testers will better understand what to look for.\u00a0 Apparently, many of the deadlines and implementation requirements were adjusted by EPA in response to comments on the proposed rule.<\/p>\n<p>Conversely, in response to comments regarding the potential costs on small business owners, EPA responded that it carefully considered such potential impacts of the proposal; EPA declined to implement recommendations of a small business advocacy review panel under the Regulatory Flexibility Act as some commenters suggested. \u00a0Finally, while EPA\u2019s final rule allows records to be maintained on paper or electronically, in keeping with the move to electronic filings and submittals, the agency encourages owners and operators to maintain electronic records to \u201csimplify compliance\u201d and utilize \u201c21<sup>st<\/sup>\u00a0century technology tools.\u201d<\/p>\n<hgroup>\n<h2 its long-awaited CISWI Rule in the Federal Register on February 7, 2013. 78 FR 9112. The final rule, entitled \u201cCommercial and Industrial Solid Waste Incineration Units;<br>Reconsideration and Final Amendments; Non-Hazardous Secondary Materials That Are Solid<br>Waste,\u201d contains the provisions in EPA\u2019s 2011 rule, vacated in January 2012, that EPA agreed to<br>reconsider. The 2011 final rule in turn superseded EPA\u2019s 2000 CISWI rule. The new CISWI Rule<br>amends 40 CFR part 60 subparts CCCC and DDDD and part 241. The amendments to 40 CFR part 60 subpart DDDD, along with certain incorporations by reference, were effective on the<br>promulgation date; amendments to part 60 subpart CCCC are effective August 7, 2013, and those to 40 CFR part 241 are effective April 8, 2013.<br>In response to both the court\u2019s vacatur of a Notice of Delay issued in 2011 and the numerous petitions for reconsideration and comments submitted by the regulated community and the<br>public, the final rule includes three subcategories of ERUs (energy recovery units) and two<br>subcategories for waste-burning kilns based on design-type differences, with separate carbon<br>monoxide (CO) limits for the latter. Certain limits were also revised based on comments<br>regarding the CO span methodology and on incorporation of additional data. The rule establishes<br>stack testing and continuous monitoring requirements and allows for the use of continuous<br>emissions monitoring systems (CEMS), setting levels based on a 3 hour block or 30-day rolling<br>average (depending on the parameter and subcategory of CISWI).<br>The rule addresses and preserves a source\u2019s choice to cease or start combusting solid waste at<br>any time due to market conditions or other reasons, and to switch from one set of applicable<br>emission standards to another pursuant to CAA section 112, thereby amending the original \"once<br>in always in\" approach reflected in the earlier versions of this rule. This in turn will provide an<br>incentive to the regulated community to continue operating incinerators.<br>The deadline for compliance with the CISWI Rule by existing sources depends primarily on when the state implementation plan incorporating the final rule is approved, with such approval<br>required no later than five years after the February 7, 2013 Federal Register publication date. The effective date for new source compliance is August 7, 2013 or the date of startup, whichever date is later.
